End User License Agreement (EULA)

Effective Date: December 13, 2024

This End User License Agreement (“Agreement”) is a legal contract between you (“User” or “Player”) and Faet Studio (“we,” “us,” “our”) governing your use of the Faet video game (“Game”). Faet is a web3-enabled RPG developed using the RPG Maker MZ game engine created by Gotcha Gotcha Games. By downloading, installing, or accessing the Game, you agree to be bound by the terms of this Agreement. If you do not agree, do not download, install, or access the Game.

Additionally, this game has not been rated by any official rating board. By accessing and playing the game, you acknowledge that the content may not be suitable for all audiences.

1. License Grant

1.1. Faet Studio grants you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the Game for personal, non-commercial purposes.

1.2. The Game is developed using the RPG Maker MZ engine and incorporates assets licensed under its terms. You agree to comply with all terms and conditions of the RPG Maker MZ software license in addition to this Agreement.

1.3. You may not copy, modify, distribute, sell, or lease any part of the Game, its content, or its underlying assets without explicit written permission from Faet Studio.

1.4. Company Assets (including text, music, and images provided by RPG Maker MZ) may only be used within User Games created using RPG Maker MZ and are subject to modification or use in compliance with Gotcha Gotcha Games’ license.

2. Ownership and Intellectual Property

2.1. The Game, including but not limited to its design, characters, assets, music, code, and NFTs, is the intellectual property of Faet Studio and/or its licensors.

2.2. Any in-game assets such as NFTs and tokens acquired, created, or used within the Game are governed by blockchain protocols. Ownership of these assets does not confer any rights to the underlying intellectual property unless explicitly stated.

2.3. User-created games, using RPG Maker MZ, retain intellectual property rights for user-created content, but Company Assets and RPG Maker MZ program files remain the intellectual property of Gotcha Gotcha Games.

3. Blockchain Integration and User Responsibilities

3.1. The Game leverages blockchain technology to enable NFTs and token transactions. By interacting with blockchain features, you accept the following:

3.2. You are responsible for securing access to your cryptocurrency wallet, including safeguarding private keys and recovery phrases.

3.3. You agree to comply with all applicable laws and regulations, including tax obligations related to blockchain transactions.

4. User Conduct

4.1. Prohibited activities include:

4.2. Faet Studio reserves the right to suspend or terminate accounts engaging in prohibited activities.

5. Updates and Modifications

5.1. Faet Studio may update, modify, or discontinue any part of the Game at any time. This includes changes to gameplay, blockchain integrations, or other features.

5.2. Continued use of the Game after updates constitutes acceptance of the revised terms.

5.3. Modifications to Company Assets provided by RPG Maker MZ are permitted only within the scope of creating User Games, as defined by Gotcha Gotcha Games’ licensing agreement.

6. Termination

6.1. This Agreement remains effective until terminated by either party. Faet Studio may terminate access to the Game if you violate this Agreement.

6.2. Upon termination, your right to access the Game ceases, but the User retains all privately owned digital assets. Blockchain networks may also retain records of asset ownership and transaction history permanently.

7. Limitation of Liability

7.1. To the maximum extent permitted by law, Faet Studio is not liable for:

7.3. Gotcha Gotcha Games is not liable for damages resulting from the use or distribution of User Games created with RPG Maker MZ, except as explicitly outlined in their User License Agreement.

8. Governing Law and Dispute Resolution

8.1. This Agreement is governed by and construed in accordance with the laws of The United States of America.

8.2. Any disputes arising from this Agreement will be resolved in the courts of the State of Louisiana.
